CRD IV & COREP:

The implementation of CRD IV (the new Prudential rules) is set to increase the prudential soundness of banks and investment firms in the aftermath of the financial crisis.

Given the scope of the new CRD IV regulations, it is likely your business has been impacted since its implementation in 2014.

Since then, we have been heavily involved in assisting a variety of firms with their new reporting requirements under CRD IV,  such as Common Reporting (COREP), that covers reporting of capital requirements and own funds.

Who is affected by CRD IV?

So, as a quick reminder, CRD IV will affect the following firms:

Investment firms that are currently subject to the Capital Requirements Directive (CRD) including:

o those firms that benefit from the current exemptions on capital requirements and large exposures for specialist commodities derivatives firms;

o those firms that only execute orders and/or manage portfolios, without holding client money or assets;

o those firms that are subject to BIPRU.

In addition, other firms in the investment sector, subject to certain CRD IV provisions (e.g. on ‘initial capital’ in the Directive):

o exempt-CAD firms;

o Management Companies as defined under the UCITS Directive;

o Alternative Investment Fund Managers ‘AIFMs’, as defined under the Alternative Investment Fund Managers Directive (AIFMD).
